Grant of Rights for FXBlue Creations Hub Tools

Between: the user who publishes the Tool (the "Contributor") and the user who obtains it (the "User").

1. Grant of rights

By publishing a Tool on the FXBlue Creations Hub, the Contributor grants the User, to the extent copyright or any other intellectual property right subsists in the Tool, or where no such right subsists, such other permission or consent as is necessary, a perpetual, irrevocable, worldwide, non-exclusive and non-transferable right to install, run and use the Tool in any MyTrader account (FXBlue-branded or broker/prop-branded version of MyTrader or a successor platform) owned or controlled by the User, for the User's own trading and analysis purposes. By obtaining a copy of a Tool, the User agrees to be bound by these terms.

2. Restrictions

Without the Contributor's prior written consent, the User must not:

  • redistribute, sublicense, sell, rent or otherwise make the Tool or its source code available to any third party;
  • incorporate the Tool, or any part of its code, into another product or service;
  • remove or obscure any attribution associated with the Tool; or
  • use the Tool for any unlawful purpose.

3. Contributor's warranty

The Contributor represents that they hold, or are entitled to grant, all rights necessary to make the Tool available on these terms, and that the Tool does not infringe the rights of any third party.

4. Disclaimers and risk

The Tool is provided "as is". The User obtains and uses the Tool entirely at their own risk, in their own trading environment and under their own account. The User is responsible for deciding whether a Tool is suitable and for testing it before relying on it. Nothing in the Tool or its description constitutes investment, trading, financial or professional advice. Subject to Clause 3, and to the maximum extent permitted by applicable law, the Contributor shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or opportunity, arising from the Tool.

5. Survival

A copy already obtained by the User remains subject to these terms even if the Contributor later deletes the Tool or closes their account.

6. Disputes

Any dispute between the Contributor and the User arising out of or in connection with this grant of rights is between them. FXBlue is not a party to it.
